Terms of Service

1. Access and Registration

You must be at least 18 years old (or have parental/guardian consent if between 13 and 18) to use SamvaadGrid. By registering, you represent that all information provided is accurate and complete. You are responsible for maintaining the confidentiality of your account, API credentials, and password.

2. License to Use

SamvaadGrid grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your business WhatsApp account, subject to these Terms. You may not:

• Resell, sublicense, or transfer your account access to unauthorized third parties.
• Remove any copyright, trademark, or proprietary notices from our software or dashboard.
• Reverse engineer, decompile, or attempt to extract the source code of the Platform.
• Use the Platform for any unlawful, abusive, or unauthorized purpose, including spamming, harassment, or actions that violate Meta's WhatsApp Business policies or Indian law, including the DPDP Act, 2023.
• Modify, copy, or create derivative works of any part of the Platform.

3. User Content & Conduct

You are solely responsible for any text content, media, prompts, and automated replies you send using SamvaadGrid. You agree not to use the Platform to harass, threaten, or violate the rights of others, or to send spam communications. We reserve the right to suspend or terminate accounts that violate Meta's WhatsApp Policies or engage in spam activities.

4. Payments & Billing

Access to the Platform after the free trial requires payment of subscription fees as described on our plans. All payments are processed through secure third-party gateways (e.g., Razorpay / Stripe). All purchases are final and non-refundable, except as explicitly outlined in our Refund Policy.

5. Intellectual Property

All software, layout designs, visual chatbot builders, branding, and assets associated with SamvaadGrid are the exclusive property of SamvaadGrid and iTechFixr Infotech LLP.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. SAMVAADGRID DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation of Liability

To the maximum extent permitted by law, SamvaadGrid and iTechFixr Infotech LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Platform, automated messages, or AI replies.

8. Governing Law

These Terms are governed by the laws of India. Any disputes or legal proceedings arising from these Terms or the use of SamvaadGrid shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
